TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale govern all sales made through the online shop on manuelaluchtmeijer.com.

2. Purpose
These Terms and Conditions of Sale define the rights and obligations of the seller and the customer in connection with sales made through the online shop on manuelaluchtmeijer.com.
They apply to the products offered for sale on the website, including Fine Art Prints, notebooks and other creations available in the shop.
Any order placed on the website implies acceptance of these Terms and Conditions of Sale.
3. Products
The essential characteristics of each product are described on its product page.
Fine Art Prints are reproductions of artworks by Manuela Luchtmeijer, printed according to the specifications indicated on each product page.
The photographs and interior settings shown on the website are intended to provide as accurate a representation of the products as possible. Images showing framed prints are suggestions for presentation purposes. Unless expressly stated otherwise, Fine Art Prints are sold unframed.
Slight differences in colour may occur depending on the screen used and shall not be considered a defect in the product.
4. Prices
Prices are indicated in euros (€).
VAT not applicable – Article 293 B of the French General Tax Code
Shipping costs are not included in the product price unless otherwise stated. They are calculated according to the destination and displayed to the customer before final confirmation of the order.
The seller reserves the right to change prices at any time. Products will, however, be charged at the price displayed at the time the order is confirmed.
5. Orders
The customer selects the products they wish to purchase and adds them to their shopping cart.
Before confirming the order, the customer can review its contents, total price, contact details and delivery address and correct any errors.
Final confirmation of the order entails an obligation to pay.
After confirmation and payment, the customer receives an order confirmation by email at the address provided when placing the order.
The seller reserves the right to refuse or cancel an order in the event of an obvious error, exceptional unavailability of a product, a payment issue or suspected fraud.
6. Payment
Payment is made online at the time of ordering using the payment methods offered on the website.
Transactions are processed by the payment service providers available through the online shop. The seller does not have access to the customer's confidential banking information.
The order is considered final once payment has been confirmed, subject to the exercise of the right of withdrawal where applicable.
7. Preparation and Dispatch
Orders are carefully prepared in Manuela Luchtmeijer's studio in Paris.
Fine Art Prints are generally dispatched within 5 to 10 business days after confirmation of the order.
This period covers the time required for printing, quality control, signing, preparation and dispatch of the order.
When an order contains several products, they may be grouped into a single shipment whenever possible.
8. Delivery
Products are delivered to the address provided by the customer when placing the order.
Shipping costs are calculated according to the destination and displayed before final confirmation of the order.
The customer is responsible for ensuring that the delivery address provided is accurate and complete.
In the event of a significant delay or delivery problem, the customer is invited to contact the seller at: manuela.luchtmeijer@gmail.com.
If a parcel is visibly damaged, the customer is invited to take photographs of the packaging and the product and to contact the seller as soon as possible so that an appropriate solution can be found.
9. Right of Withdrawal
In accordance with the French Consumer Code, consumer customers have a period of 14 days from receipt of the product in which to exercise their right of withdrawal, without having to provide a reason.
The customer must inform the seller of their decision to withdraw before the end of this period, either by using the withdrawal form provided at the end of these Terms and Conditions of Sale or by making any other clear and unambiguous statement expressing their decision to withdraw.

> Return shipping costs are borne by the customer.
The product must be returned carefully protected, preferably in its original packaging or in packaging providing equivalent protection to ensure that it is returned in good condition.
The customer may be held liable for any reduction in the value of the product resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the goods.
10. Refunds Following Withdrawal
In the event of a valid exercise of the right of withdrawal, the seller will refund the price paid for the returned product(s), together with the initial delivery costs corresponding to the standard delivery method offered, in accordance with applicable law.
Return shipping costs for sending the product back to the seller remain the responsibility of the customer and will not be reimbursed.
If the customer chose an initial delivery method that was more expensive than the standard delivery method offered, the additional costs will not be reimbursed.
The refund will be made no later than 14 days from the date on which the seller is informed of the customer's decision to withdraw.
The seller may, however, withhold the refund until the product has been received back or until the customer provides proof that it has been sent back, whichever occurs first.
The refund will be made using the same payment method used for the original transaction, unless the customer expressly agrees to another method of reimbursement that does not incur additional costs.
11. Personalised and Special Orders
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to goods made to the consumer's specifications or clearly personalised.
This exception may apply in particular to:
- a Fine Art Print produced specifically in a size or according to specifications requested by the customer that are not part of the standard products offered in the shop;
- an artwork or painting created specifically to order according to characteristics agreed with the customer, such as dimensions, format, composition or other particular specifications.
The personalised nature of the order and the absence of a right of withdrawal will be clearly stated to the customer before the relevant order is confirmed.
This exception does not apply to standard products normally offered in the online shop.
12. Damaged or Defective Products and Order Errors
If a product arrives damaged, is defective or does not correspond to the product ordered, the customer is invited to contact the seller as soon as possible at:
Customers are requested to include photographs of the product and, where relevant, its packaging in order to facilitate the handling of their request.
If a product is found to be defective, damaged or non-compliant, an appropriate solution will be offered in accordance with the applicable statutory guarantees.
The provisions of this section are separate from the right of withdrawal.
13. Statutory Guarantees
Products sold are covered by the applicable statutory guarantees, including the statutory guarantee of conformity and the guarantee against hidden defects, under the conditions provided for by French law.
These guarantees apply independently of the right of withdrawal.
14. Intellectual Property
The artworks reproduced on Fine Art Prints, notebooks and other products, as well as the images and creations presented on the website, remain protected by copyright.
The purchase of an artwork, Fine Art Print or any other product featuring an artwork does not entail any transfer of the intellectual property rights attached to that artwork.
Any reproduction, distribution, commercial exploitation, modification or use of the artwork without the artist's prior written permission is prohibited, subject to the exceptions provided for by applicable law.
15. Personal Data
Personal data collected when an order is placed is used in particular for processing the order, payment, delivery and customer relations.
Details regarding the collection and processing of personal data, as well as users' rights, are set out in the Privacy Policy available on the website.
16. Liability
The seller shall not be held liable for misuse of the products or for damage resulting from incorrect information provided by the customer, particularly regarding the delivery address.
The seller's liability may not, however, be limited or excluded where applicable law does not permit such limitation or exclusion.
17. Applicable Law and Dispute Resolution
These Terms and Conditions of Sale are governed by French law.

18. Changes to the Terms and Conditions of Sale
The seller may amend these Terms and Conditions of Sale, in particular to reflect changes to the online shop or applicable regulations.
The Terms and Conditions of Sale applicable to an order are those in force at the time the order is placed.
